Eligibility for Expungement

State law allows for expungement of felonies only in specific cases, almost exclusively for nonviolent crimes. To be eligible, you must:
- Have no more than three felonies on your record
- Have no active sentences

- Must not have committed any other crimes during the waiting period.
You can only have one conviction expunged at a time. You’d have to petition the court separately for other charges. What’s more, violent crimes, delitos sexuales, and other serious offenses are permanently barred from expungement. North Carolina expungement laws are strict and offer no flexibility in these cases.
